Warranty Terms – Flamingo Shop

1. Statutory Warranty (Conformiteit)

1.1. All products sold by Flamingo Shop are subject to the statutory warranty obligations under Dutch law, in particular Articles 7:17 through 7:23 of the Dutch Civil Code (“Burgerlijk Wetboek”).
1.2. This statutory warranty means that products must conform to the agreement and meet the reasonable expectations of the purchaser, taking into account the nature of the product, its description, and the purchase price.
1.3. For consumers, this conformity requirement applies for the reasonable expected lifetime of the product. Independently of this, EU Directive 1999/44/EC (and its successor Directive (EU) 2019/771) provides a minimum legal guarantee period of two (2) years from the date of delivery.
1.4. The statutory warranty applies regardless of any additional commercial warranties offered by Flamingo Shop.

2. Commercial Warranty

2.1. In addition to the statutory warranty, Flamingo Shop may, where expressly stated in the product description, provide a voluntary commercial warranty (garantie) of up to three (3) years from the date of purchase.
2.2. Such commercial warranty constitutes a contractual commitment by Flamingo Shop to remedy defects occurring during the specified period, by repair, replacement, or refund, at Flamingo Shop’s discretion.
2.3. A commercial warranty does not limit, replace, or affect the consumer’s statutory rights under Dutch or European law.

3. Special Categories and Exclusions

3.1. Certain products are supplied exclusively for development, prototyping, testing, or evaluation purposes. These include, but are not limited to, development kits, evaluation boards, and experimental hardware.
3.2. For such products, Flamingo Shop guarantees solely that the product will be functional upon delivery (“Dead on Arrival Guarantee” as specified in Article 4).
3.3. These products are expressly excluded from any commercial warranty against defects occurring after delivery.
3.4. This exclusion does not affect the statutory conformity rights of consumers with respect to the condition of the product upon delivery.

4. Dead on Arrival (DOA) Guarantee

4.1. If a product, including those excluded from commercial warranty under Article 3, is found to be non-functional upon delivery, the purchaser must notify Flamingo Shop within seven (7) calendar days of receipt.
4.2. Upon verification of the defect, Flamingo Shop shall, at its sole discretion, provide one of the following remedies:
    a) replacement of the product with an identical or equivalent product;
    b) repair of the product; or
    c) refund of the purchase price.
4.3. Remedies provided under this DOA Guarantee are without prejudice to statutory rights under Dutch or European law.

5. Limitations of Warranty Coverage

5.1. The statutory and commercial warranty does not cover defects or damage arising from:
    a) improper installation, operation, or maintenance;
    b) modifications, alterations, or repairs performed by unauthorized third parties;
    c) connection to incompatible equipment, accessories, or power sources;
    d) accidental damage, negligence, misuse, or exposure to liquids or other contaminants;
    e) normal wear and tear consistent with the intended use of the product.
5.2. The foregoing limitations do not affect or diminish the statutory rights of consumers under Dutch law.

6. Claims Procedure

6.1. Warranty claims must be submitted in writing to Flamingo Shop, accompanied by proof of purchase and, where applicable, a detailed description of the defect.
6.2. Flamingo Shop may request the return of the defective product for inspection prior to granting any remedy.
6.3. Costs of returning products shall be borne by Flamingo Shop in the case of justified warranty claims. Where a claim is rejected, return costs may be charged to the purchaser.

7. Governing Law

7.1. These Warranty Terms are governed by and construed in accordance with the laws of The Netherlands.
7.2. Nothing in these Warranty Terms shall exclude, restrict, or limit any statutory rights of consumers under applicable Dutch or European Union law.
